Terms of service

entire contents of this TOS and you understand and agree to any and all

This TOS covers all of our services for hosting and website design.
Illegal, Get-Rich-Quick, Warez, Copyright Infringing,
or Spammed Websites BEWARE! They are Illegal and we will prosecute all
abusers of the Internet.
No Pornographic materials are allowed on our servers.
We reserve the right and total control to Immediately shut down any
site that violates this TOS or is in any way promotes illegal activity.
You, as our client, are completely responsible for any and all
content on our servers and we as the service provider are in no way held
responsible for you, the client, or your actions
We provide to business and consumer users several information
technology-related services, including such services as: electronic mail
(e-mail), packages and services, World Wide Web website hosting
arrangements, and other online and Internet-related services. The
Agreement provides the terms and conditions governing the services
provided by and use of the website (the "SITE"). The SITE
provides registered Clients (each a "Client") with a package
of content and services, which may, in our sole discretion, be
supplemented, deleted or otherwise altered at any time. By registering
as a Client, you agree to use the SITE in accordance with all the TOS.
Some services provided on this SITE are available at no charge,
exclusive of other Internet or other telecommunications fee. The SITE
does not discriminate on the basis of age, gender, or ethnicity. If the
services provided by us become available by subscription only, or
features of the SITE become available for a fee, the SITE may provide
Users with a new TOS and Use Agreement, and Clients will have the
opportunity to review and accept the new terms at that time.
WE PROVIDE SPACE FOR WEBPAGES, BUT MAKE NO IMPLIED OR EXPRESS
WARRANTIES ABOUT THE RELIABILITY OF THESE PAGES. WE ARE NOT RESPONSIBLE
FOR ANY DAMAGE CAUSED BY LOSS OF ACCESS TO, OR DELETION OR ALTERATION OF
WEBPAGES. INDIVIDUAL CLIENTS ARE RESPONSIBLE FOR MONITORING AND CREATING
BACKUPS OF THEIR WEBSITES.
The following is a non-exclusive list of actions and content that are
not permitted on the SITE or through any service provided by us:
You may not use any device, software or routine to
interfere or attempt to interfere with the proper working of the SITE or
any use being conducted on the SITE. You may not take any action which
imposes an unreasonable or disproportionately large load on our
infrastructure. This includes the storage of large files (.zip, .exe,
.mp3, etc.) and/or heavy downloading of files.
Posting any single article or advertisement to more than ten (10)
Usenet or other newsgroups, forums, e-mail mailing lists or other
similar groups or lists;
Posting to any Usenet or other newsgroup, forum, e-mail mailing list
or other similar group or list articles which are not relevant to, or
otherwise suitable for, the charter or other owner-published FAQ or
description of such group or list;
Sending unsolicited mass e-mailings to more than twenty-five (25)
e-mail users;
Falsifying user information provided to us or to other users of the
service in connection with use of our service;
Using our name, or your SITES e-mail address (whether as a Reply to:
and as the From: Header), or advertising your SITE via Unsolicited
Commercial Bulk e-mail as defined above.
Using copyrighted or trademarked material in any manner without the
express permission of the author or owner.
Creating content that includes nudity or exploits the images of
children under 18 years of age, or is grossly offensive to the SITE
community, including clear expressions of bigotry, racism, or hatred, or
that defames, abuses or threatens others.
Promoting illegal activity.
Creating content that is inconsistent with the values of the spirit
of the SITE community.
Using a SITE or a web page as storage for remote loading.
Engaging in any of the foregoing activities using the service of
another provider, but channeling such activities through our server or a
remailer, or using a your SITE as a maildrop for responses;
All material on the SITE, including, without limitation, text,
software, photos, video, graphics, music and sound, is protected by U.S.
and international copyright laws, both as individual works and as a
collection. The downloading or use of copyrighted material provided by
the SITE or a third-party content provider is allowed by Users for
personal use. Users may not copy, reproduce, retransmit, distribute,
publish, commercially exploit, or otherwise transfer any such
copyrighted material in any format, electronic or otherwise.
Any material protected by copyright may not be placed on your SITE or
a web page without the expressed written consent of the author or owner
of the copyright of that material.
You agree to immediately notify us of any unauthorized use of
Member's account or any other breach of security known to Member.
We assume no responsibility for the deletion or failure to store email messages
Once you become our client, you will receive a password and an account. You are entirely responsible if you do not maintain the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities which occur under your account. You may change your password at any time by following instructions.
Email is private correspondence between the sender and the recipient.
It is our policy to respect the privacy of its clients. Therefore, in addition to the privacy of registration data we will not monitor, edit, or disclose the contents of a client's private communications unless required to do so by law or in the good faith belief that such action is necessary to: (1) conform to the edicts of the law or comply with legal process served on us; (2) protect and defend the rights or property owned or controlled by us; or (3) act under exigent circumstances to protect the personal safety of our members or the public.
Client acknowledges and agrees that we neither endorses the contents of any clients communications nor assumes responsibility for any threatening, libelous, obscene, harassing or offensive material contained therein, any infringement of third party intellectual property rights arising therefrom or any crime facilitated thereby.
Client acknowledges and agrees that certain technical processing of email messages and its content may be required to: (1) send and receive messages; (2) conform to connecting networks' technical requirements; (3) conform to the limitations of the Service; or (4) conform to other similar requirements.
WE MAKE NO WARRANTY THAT THESE SERVICES OR OUR SERVER WILL MEET YOUR REQUIREMENTS, OR THAT THE SERVICE OR OUR SERVER WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR DO WE MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH OUR SERVER OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED.
CLIENT UNDERSTANDS AND AGREES THAT ANY MATERIAL AND/OR DATA DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF OUR SERVER IS DONE AT CLIENTS OWN DISCRETION AND RISK AND THAT THE CLIENT WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO OUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH MATERIAL AND/OR DATA.
WE MAKE NO WARRANTY REGARDING ANY GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH OUR SERVER OR ANY TRANSACTIONS ENTERED INTO THROUGH OUR SERVER.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY CLIENT FROM US OR THROUGH THE SERVICE OR OUR SERVER SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, RESULTING FROM THE USE OR THE INABILITY TO USE THIS SERVICE OR FOR COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR RESULTING FROM ANY GOODS OR SERVICES PURCHASE OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH THIS SERVICE OR RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF CLIENT'S TRANSMISSIONS OR DATA, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
Client is solely responsible for the contents of his or her transmissions through the Service.
Client's use of our Services' is subject to all applicable local, state, national and international laws and regulations.
Client agrees: (1) to comply with US law regarding the transmission of technical data exported from the United States through the Service; (2) not to use the Service for illegal purposes; (3) not to interfere or disrupt networks connected to the Service; and (4) to comply with all regulations, policies and procedures of networks connected to the Service.
The Service makes use of the Internet to send and receive certain messages; therefore, Client's conduct is subject to Internet regulations, policies and procedures. Client will not use the Service for chain letters, junk mail, spamming or any use of distribution lists to any person who has not given specific permission to be included in such a process.
Client agrees not to transmit through the Service any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material of any kind or nature. Client further agrees not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law or regulation. Attempts to gain unauthorized access to other computer systems are prohibited.
Client shall not interfere with another Client's use and enjoyment of the Service or another entity's use and enjoyment of similar services.
We may, at its sole discretion, immediately terminate Service should Client 's conduct fail to conform with these terms and conditions of the
TOS.

Additional features
Additional features and services are billed on a hourly and per case basis.
Site design services are priced based on the average time it takes to set up the design package you will choose. It should be known that extensive script writing, code authoring, extra features, or troubleshooting could incur extra charges. You will be notified by e-mail to authorize said charges before they incur.
Our Site Management and Maintenance package is designed to be a tool used to keep our clients ongoing Internet costs minimal. It is not intended to provide clients with a means to reconstruct or rewrite their entire site, add E-Commerce capabilities, or any other large projects or additions. Monthly site management and updates usually takes a couple of hours a month to re calculate you web, test hyperlinks, general maintenance, and for ongoing updates. Client's who do not have the ability to maintain their website on their own, and do not have a Maintenance agreement with us will be billed by the hour or on a per case basis for changes.
Page: One page is considered one 8.5 x 13 page of printed text in a "normal" MS Word font or 18 second download time thru a 56 k modem.
Image scan: One image 8.5 x 13 or smaller converted from paper to a digital web image.
POP Account: An E-mail account such as You@yourdomain.com.
Alias: An E-mail account such as Info@yourdomain.com.
Auto responders: A E-mail message you write is automatically sent in response to any E-mail address you specify.
Submitable Order forms page: Allows the results of a form to be automatically forwarded to any E-mail address of your choice. One page includes 10 entry fields, one reset button, and one submit button.
No graphics design is included in any of our design packages. We can scan printed images for use on the Internet, however, making them from scratch is called "graphics design" and incurs additional costs.
If you are chosen for the "Featured site of the month" you agree to let us use hidden scripts in your pages. These scripts do not alter your sites functions an are not visible. They are for search engine use only.
We will not ever sell your name or any other information to mailing lists, however, you will be on ours for updates and special feature discounts. To disable our list send and e-mail message to
"sales@LakeCityWebs.com" with "disable" in the subject box.
We are not responsible for technologies, scripts or links that become unavailable or obsolete beyond our control.
You may cancel any design or hosting
agreement within 72 hours of your initial purchase by e-mailing
"cancel@LakeCityWebs.com" with "Cancel" in the
subject box and a simple explanation and your contact information in the
body of the message.
You may cancel any Monthly hosting
agreement at anytime. All fees will be prorated by the month. No refunds
for partial months.
Purchasing Annual contracts allows us to buy space in bulk, therefore,
You may not cancel any Annual hosting agreement before the term is up.
You may transfer your domain name and any html code you own from our
servers at any time, but no refunds for unused months will be issued
under any circumstances.
You will be responsible for any and all fees incurred should your
account be past due or sent to our collections partner. If your account
is temporarily shut off due to non payment a $70.00 Re-connection fee
will be due before any Re-connection is to the Internet is established.
